Cayman Immigration tonight issued the following guidance for those bumping up against the seven year term limit.

TERM LIMIT EXEMPTION PERMITS

Forthcoming changes to our immigration legislation have important consequences for persons (and their employers) who have reached the expiry of their term limit recently, or who will reach it within the next two years. From the date [not yet known] on which the Immigration (Amendment)(No.3) Law, 2011 is published in the Gazette (“the publication date”) it will be possible for an employer, or prospective employer, of a person –

(a) whose final work permit expired within the thirty days prior to the publication date; or

(b) whose final work permit expires after the publication date; or

(c) who was working by operation of law on the publication date by virtue of having applied for key employee designation and the application is subsequently refused

to apply for a Term Limit Exemption Permit which, if granted, will allow themto remain employed in the Islands, either for their last employer or for a new employer, for another two years after the publication date even though their term limit has expired.

Will the worker be allowed to work while awaiting the outcome of the appeal?

All the requirements contained in section 44 of the Immigration Law. For example, the health and character of the worker, his ability to support himself and his dependants, and the efforts that the applicant has made to identify a Caymanian for the position.

No.

Does the worker have to work for the same employer who held their final work permit or can they change employers?

The worker can work for any employer. If they wish to continue working for the same employer as before, then their employer will have to submit a Term Limit Exemption Permit grant form application before the expiry of the worker’s term limit.

If a different employer wishes to employ them for this two-year period then they must submit a Term Limit Exemption Permit grant form application but the worker is not allowed to continue working until the application is approved.
